These Terms of Service ("Terms") govern your use of the temperis.pro website, the Temperis desktop application (the "App"), and the optional Temperis Brain hosted service (the "Brain") (together, the "Services"), operated by Temperis ("we", "us"). By downloading, purchasing, activating, or using any of the Services, you agree to these Terms, to the End User License Agreement ("EULA"), and to the Privacy Policy. If you do not agree, do not download or use the Services.
You must be at least 18 years old, or the age of majority where you live, to purchase the Services; minors may use the Services only with a parent or guardian who accepts these Terms on their behalf. A free Temperis account (username, email, password) is required to download the App, start a trial, or purchase; entitlements are then delivered as license keys tied to that account and visible on your account page. You are responsible for keeping your license keys confidential. Keys are personal to you and may not be shared, published, resold, or transferred except as the EULA allows.
Two products are offered: (a) the Temperis App, a one-time purchase granting a perpetual license to the App under the EULA; and (b) the Temperis Brain, an optional recurring subscription to a hosted orchestration service. Current pricing is shown at checkout. Payments are processed by Stripe, acting as merchant of record; your purchase is also subject to Stripe's applicable buyer terms, and applicable taxes are calculated and collected at checkout. We never see or store your full payment card details.
We may offer a free trial of the App (currently 7 days, no card required). One trial per person. Trial keys expire automatically at the end of the trial period; continued use requires a purchase. We may modify or withdraw the trial offer at any time. Obtaining additional trials through alias or disposable email addresses is a violation of these Terms and may result in revocation of keys.
App: if you are not satisfied, email support@temperis.pro within 7 days of purchase for a full refund, no questions asked. Upon refund your license key is revoked and your right to use the App ends.
Brain subscription: you can cancel at any time by emailing support@temperis.pro; cancellation stops future renewals and your access continues to the end of the paid period. Except where required by law, partial-period refunds are not provided. If we permanently discontinue the Brain while you have prepaid time remaining, we will refund the unused portion pro rata.
Nothing in this section limits any non-waivable statutory rights you have (for example, withdrawal rights available to consumers in some jurisdictions, which are administered through Stripe as merchant of record).
The Brain is a hosted service provided on an "as available" basis. When you use it, the content of your requests (including code and prompts your editor sends) is processed in transit on our servers to orchestrate your session and is not retained after processing, as described in the Privacy Policy. Model inference runs through the model providers you configure in the App, under your own keys and their terms — the Brain directs the work; your machine and your providers execute it. We may update, improve, or modify the Brain at any time, and may suspend access for maintenance, security, or abuse. Scheduled subscription benefits are described at purchase; we do not guarantee uninterrupted availability.
We may suspend or revoke keys involved in violations. Where practical we will warn first; we may act immediately when required to protect the Services or other users.
Your code, projects, and files remain yours. We claim no ownership over anything you create with the Services. AI-generated output can be wrong, insecure, or subject to third-party rights; you are responsible for reviewing and testing anything you accept into your work. The Services drive real actions on your machine (file edits, terminal commands) under permission controls you configure — you are responsible for the permissions you grant and the actions you approve.
The Services, including the App, the Brain, and this website, are protected by copyright and other laws. Except for the license expressly granted in the EULA, no rights are granted to you. "Temperis" and associated logos may not be used without our permission. Open-source components included in the App are listed with their licenses in the App's third-party notices.
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI OUTPUT WILL BE ACCURATE OR SAFE TO USE WITHOUT REVIEW.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, OR FOR LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATING TO THE SERVICES. OUR TOTAL AGGREGATE LIABILITY WILL NOT EXCEED THE AMOUNTS YOU PAID US FOR THE SERVICES IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO PARTS OF THIS SECTION MAY NOT APPLY TO YOU.
You will defend and indemnify us against claims arising from your violation of these Terms or your unlawful use of the Services.
You may not use the Services in violation of applicable export-control or sanctions laws, and you represent that you are not located in an embargoed jurisdiction or on a restricted-party list.
We may update these Terms from time to time. Material changes will be posted on this page with an updated date; for significant changes affecting paid Services we will make reasonable efforts to give advance notice (for example, on this site or in the App). Continued use after changes take effect constitutes acceptance. If you do not agree to a change, stop using the Services and, for subscriptions, cancel.
You may stop using the Services at any time. We may terminate or suspend the Brain service or revoke keys for material breach of these Terms or the EULA. Sections that by their nature should survive (including 7–11 and 15) survive termination. A validly purchased perpetual App license survives termination of these website terms except where revoked for breach or refunded.
These Terms are governed by the laws of the United States and of the U.S. state in which the operator of Temperis resides, without regard to conflict-of-law rules. Before filing any claim, you agree to contact support@temperis.pro and attempt in good faith to resolve the dispute informally for 30 days. Purchases are made from Stripe as merchant of record and may also be subject to Stripe's dispute processes.
